Terms of Use for Vocabulary Trainer Shchebitka

Welcome to Shchebitka. Shchebitka is a personal vocabulary application that allows users to create, manage, and organize custom vocabulary lists. The service may be accessed through websites, APIs, AI assistants, client applications, Actions, tools, connectors, and Model Context Protocol (MCP) integrations.

By accessing or using Shchebitka, or by connecting it to any third-party assistant, client, or integration, you agree to these Terms of Use. If you do not agree, do not use the service.

Shchebitka provides tools that enable users to:

• Create and manage personal vocabulary lists
• Add, edit, and delete words and definitions
• Organize vocabulary for learning and reference purposes

The service may process user inputs and return structured vocabulary data through AI assistants, client integrations, APIs, and MCP-compatible tools.

Shchebitka is intended for language-learning and vocabulary-management purposes only. The service is not intended for legal, medical, financial, compliance, safety-critical, or other high-risk use cases.

You must comply with all applicable laws when using this service. By using Shchebitka, you represent that you are permitted to do so under your local laws.

If you use Shchebitka on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You agree not to:

• Use the service for unlawful, harmful, fraudulent, or abusive purposes
• Attempt to disrupt, overload, disable, or exploit the service
• Submit content that violates applicable laws or third-party rights
• Reverse engineer, probe, scan, or test the vulnerability of the service except where expressly permitted in writing
• Interfere with security features, rate limits, access controls, or technical protections
• Use bots, scripts, or automated methods to abuse, scrape, extract, or overload the service beyond permitted functionality
• Upload, transmit, or submit malware, malicious code, prompt injection payloads, or content designed to disrupt systems or integrations
• Use the service to store or process sensitive personal data, confidential information, regulated data, or any data you do not have the right to provide
• Misrepresent your identity, impersonate others, or use the service in a way that could create legal liability for Shchebitka

You are solely responsible for:

• the content you create, submit, or store using the service
• verifying that your use of the service is appropriate for your purposes
• reviewing any outputs before relying on or using them
• maintaining your own backups of any data you consider important
• any activity that occurs through your account, credentials, tokens, or connected integrations

Shchebitka processes user-provided data, such as words and vocabulary lists, to provide its functionality.

• Data may be transmitted between third-party assistants, clients, integrations, APIs, or MCP-compatible tools and Shchebitka services
• The service may temporarily process or store user inputs to function properly
• No guarantees are made regarding long-term storage, backup, or data retention

Users should avoid submitting sensitive or confidential information.

Use of the service is also subject to the Privacy Policy. If these Terms and the Privacy Policy conflict, these Terms govern with respect to permitted use of the service, and the Privacy Policy governs with respect to privacy and data handling disclosures.

You retain ownership of the content you submit to Shchebitka.

You grant Shchebitka a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as technically necessary, transmit, and process your content solely for the purpose of operating, securing, maintaining, and improving the service.

You represent and warrant that you have all rights necessary to submit the content you provide and to grant the license described above.

Outputs generated, retrieved, reformatted, or returned through Shchebitka may be incomplete, inaccurate, unavailable, duplicated, improperly formatted, or influenced by third-party assistants, models, or integrations.

You must independently review and verify all outputs before relying on them. Shchebitka does not guarantee the accuracy, completeness, legality, non-infringement, or fitness of any output for your specific purpose.

Shchebitka may operate through or alongside third-party AI assistants, client applications, APIs, hosting providers, and other integrations, including MCP-compatible environments. Your use of those third-party services is subject to their separate terms and privacy policies.

Shchebitka is not responsible for third-party platform availability, model behavior, service interruptions, policy changes, account restrictions, data handling outside Shchebitka systems, or actions taken by those third parties.

The service is provided on an "as is" and "as available" basis.

• Availability may be interrupted
• Features may change or be discontinued at any time
• No uptime, delivery, compatibility, or reliability guarantees are provided

To the fullest extent permitted by law, Shchebitka is provided without warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Accuracy of results
• Fitness for a particular purpose
• Continuous availability
• Merchantability
• Non-infringement
• Security, reliability, or error-free operation

To the fullest extent permitted by law, the operator of Shchebitka shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

• use or inability to use the service
• loss of data, content, profits, revenue, goodwill, or business opportunity
• errors, interruptions, or delays in service
• third-party platform failures, AI assistant failures, model behavior, or integration errors
• unauthorized access, security incidents, or misuse by third parties

To the fullest extent permitted by law, the total aggregate liability of the operator of Shchebitka for any claim arising out of or relating to the service or these Terms will not exceed the greater of:

• the amount you paid to Shchebitka for the service in the 6 months before the event giving rise to the claim
• USD 50 if you did not pay anything for the service in that period

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless the operator of Shchebitka from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• your content
• your misuse of the service
• your violation of these Terms
• your violation of applicable law or third-party rights
• your use of third-party platforms or integrations in connection with Shchebitka

These Terms of Use may be updated from time to time. The updated version will be posted with a revised "Last updated" date. Material changes will apply prospectively from the date they become effective. Continued use of the service after the effective date of updated Terms indicates acceptance of the revised Terms.

Access to Shchebitka may be suspended, restricted, or terminated at any time, with or without notice, for any reason, including suspected misuse, legal risk, security risk, operational risk, or violation of these Terms.

Upon termination:

• your right to use the service ends immediately
• some or all of your data may be deleted without liability, subject to applicable law and operational constraints
• you remain responsible for obligations incurred before termination

Shchebitka has no obligation to maintain, export, or return any content after termination.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Failure to enforce any provision of these Terms is not a waiver of that provision.

These Terms constitute the entire agreement between you and Shchebitka regarding the service, except for any additional written agreement expressly entered into by the operator of Shchebitka.

Any sections of these Terms that by their nature should survive termination will survive, including provisions relating to ownership, disclaimers, limitations of liability, indemnification, termination, and miscellaneous terms.
